Doing What is Best for Your Child
When it comes to child custody cases, the courts have one goal. They want to do what is best for your child. It is important that you understand that the courts will want both parents involved in the child's life, unless there are extreme circumstances. Still, you have the right to protect your interests. You have the right to show the court that the outcome your requesting is the outcome that is in the best interest of your child. At the Law Offices of Phil Hineman, P.C., we are here to help.
Sole Custody and Joint Custody
In terms of how custody is assigned, there are essentially two options: sole custody and joint custody. Sole custody means that one parent has primary responsibility for the child. There may certainly be a child visitation plan or a parenting plan arranged to ensure that the other parent has time with the child as well. Joint custody means that responsibility is shared, although not necessarily evenly (in regards to visitation), between the two parents.
Legal Custody and Physical Custody
Custody is broken down further into legal custody and physical custody. Physical custody is what people traditionally think of when they think of child custody. It refers to the time the parent and the child spend together, as well as which parent the child resides with. Legal custody refers to the power to make important decisions, such as schooling and medical care.
